Insurance wont replace car seat after accident.

Are you sure there are no cracks in the seats? Has the insurance company inspected them? Because I'm pretty sure there ARE cracks in those seats, if you just look hard enough. Try using a hammer to look, that really helps sometimes.

I find a hammer helps immensely when dealing with insurance companies.... All sorts of practical uses. LOL

I live in CA and we successfully had our insurance company replace our 2 new GN's when dh was rear ended (even though the seats were unoccupied at the time of the crash). We had a letter from Graco, asked for them to accept liability in the case of an accident where the seats failed, and scanned the pages of the instruction book where it said not to use the seats after any accident. It was actually quite easy. They would only cover to replace the same seats (ie we couldn't "upgrade" to different seats...but we had just gotten the GN's so we were fine with that).

My sister was in an accident and her children were in the car in there car seats another driver hit her and it was there fault but they did not have insurance and my insurance company is saying they will not replace the car seats. This happened in Wisconsin if that helps what can we do? They were also Graco car seats.

So typically, the at-fault party would be responsible to "make whole her losses" in a crash, including replacing seats that needed to be replaced. However, since the other party is uninsured, it's a bit tricky. If she had an uninsured rider to cover this situation, tell her to use that language, that she needs her losses made whole, and provide the statement from the manual that they must be replaced as proof if needed. If she doesn't, she may be out of luck as what an insurance company covers in that situation is limited and Wisconsin is not a state that specifies that car seats must be replaced by insurance. She can still try providing the manual and asking to be made whole, and can contact Graco for additional documentation that they must be replaced, but there's a chance they won't budge.
